1. INTRODUCTION & SCOPE

This Refund & Cancellation Policy outlines the commercial terms governing all payments, retainers, and fixed-fee contracts between Adnan Zaman, trading as Azaman Analytics ("Consultant", "we", or "us"), and our corporate clients ("Client" or "you").

Because Azaman Analytics provides highly bespoke B2B enterprise consulting, data architecture, and proprietary code development, standard consumer/retail refund policies do not apply. By engaging our services and executing a Statement of Work (SOW), the Client agrees to the financial terms detailed below.

 

2. GENERAL REFUND POLICY

2.1 No Refunds for Rendered Services: Azaman Analytics operates strictly on a professional fee-for-service basis. Once cognitive bandwidth, consulting time, diagnostic effort, or code development has been expended by the Consultant, the fees associated with that time and effort are strictly non-refundable.

2.2 Bespoke Deliverables: All architectural blueprints, SQL/Python pipelines, and analytical models are custom-built for the Client’s specific operational environment (e.g., their specific SAP ERP setup or APRA reporting requirements). Due to the irreversible and proprietary nature of this intellectual property, delivered work cannot be returned or refunded.

 

3. CANCELLATION & TERMINATION TERMS

The financial implications of a cancellation depend entirely on the specific Engagement Model outlined in the Client’s Statement of Work (SOW):

3.1 Diagnostic Audits & Wedge Projects (Fixed-Fee, Short-Term)

●       Once the diagnostic process has formally commenced (defined as the initial onboarding meeting or the transfer of initial client data), the flat fee is fully earned and non-refundable.

●       If a Client cancels prior to the commencement of the project, a refund will be issued minus a 20% administrative and scheduling fee.

 

3.2 Milestone-Based Pipeline Engineering (Fixed-Term Contracts)

●       These projects are typically billed in stages (e.g., 50% upfront, 50% upon deployment/UAT).

●       Upfront Deposits: The initial deposit secures the Consultant's bandwidth in the production schedule and covers initial architectural design. This deposit is non-refundable once work commences.

●       Mid-Project Cancellation: If the Client terminates the project prior to the final milestone, the Client will be invoiced on a pro-rata basis for all work-in-progress, code developed, and time spent up to the date of formal cancellation notice.

 

3.3 Fractional Enterprise Architecture (Monthly Retainers)

●       Monthly retainers secure a dedicated block of the Consultant's operational bandwidth.

●       Cancellation Notice: Retainers require a minimum written cancellation notice period (typically 14 or 30 days, as specified in the SOW).

●       Refunds: Fees paid for the current, active month of a retainer are non-refundable. If notice is given mid-month, the Client is responsible for paying for the remainder of the agreed notice period.

 

3.4 Strategic Day-Rate Consulting

●       Day-rate engagements operate on a timesheet or fixed-schedule basis.

●       Clients will only be billed for days/hours actually worked. Any fees already paid for days worked are non-refundable. Notice periods for terminating day-rate contracts will be governed by the specific SOW.

 

4. PROJECT DELAYS & CLIENT DEPENDENCIES

4.1 Client Responsiveness: The execution of our data architectures requires timely access to Client systems, feedback on User Acceptance Testing (UAT), and data extracts. If a project stalls for more than thirty (30) days solely due to the Client's failure to provide necessary access or feedback, Azaman Analytics reserves the right to formally pause the project and invoice for all work completed up to that date.

4.2 Resumption of Stalled Projects: If a Client wishes to resume a project that has been stalled for more than 30 days due to their own delays, a reactivation fee may apply to re-allocate scheduling bandwidth.

 

5. EXCEPTIONS & DISPUTE RESOLUTION

5.1 Non-Delivery: In the highly unlikely event that Azaman Analytics completely fails to deliver the initial scope of work as outlined in the SOW (due to circumstances solely within the Consultant's control, excluding force majeure), a partial or full refund of upfront deposits will be negotiated in good faith.

5.2 Resolution Process: Any disputes regarding billing or deliverables must be submitted in writing to adnan.zaman@azamananalytics.com within seven (7) days of invoice receipt or milestone delivery. Both parties agree to attempt to resolve disputes commercially and in good faith prior to pursuing legal action.

 

6. AMENDMENTS

Azaman Analytics reserves the right to modify this Refund Policy at any time. The policy active at the time of the execution of a Client's SOW will govern that specific engagement.
